1. Scope of the Terms and Conditions and Organizer
These general terms and conditions apply to the sweepstakes organized on-site at the European Championships and advertised via social media ads by BLACKROLL AG, Hauptstr. 17, CH-8598 Bottighofen.
2. Participation
2.1. Participation in the contest is free of charge. To participate, you must successfully register for the contest using the registration form and provide your email address. The contest ends on the last day of the event, August 21, 2022.
2.2. By participating in the sweepstakes, you accept these Terms and Conditions.
2.3. All individuals over the age of 18 residing in Germany and Austria are eligible to participate. Employees of BLACKROLL AG and of companies involved in organizing the contest, as well as their family members, are excluded from participation.
2.4. The contest is not affiliated with Facebook/Instagram; it is neither sponsored, supported, nor organized by Facebook/Instagram.
3. Prizes, Selection of Winners, and Notification
3.1. The prizes consist of 5 BLACKROLL® SLEEP SETS SUMMER each, as well as the grand prize: a weekend getaway at Hotel FRITZ Lauterbad for 2 people for 2 nights in a suite. The value of the prize varies.
3.2. The winner will be contacted via email to notify them of their prize.
3.3. Only one prize per participant is allowed. The prize cannot be exchanged, transferred, picked up in person, or redeemed for cash.
4. Grant of Rights of Use
4.1. If uploading images, the participant guarantees that they hold the necessary rights to the uploaded or linked photos. If the participant is not the sole author or rights holder, they expressly declare that they possess the rights required to participate in the contest.
4.2. The participant grants BLACKROLL AG the following simple, unlimited in time and territory, but non-exclusive, rights of use to the photo or written text used by the participant:
• the right to store the photo or post on a server;
• the right to make the photo available to the public, in whole or in part, via social media channels and our websites (www.blackroll.de/com);
• the right to use the photo to promote our products;
• the right to edit the photo, provided that the image is not altered beyond recognition.
4.3. When using the image, we will credit the author in an appropriate manner, to the extent that this is feasible given the specific form of use.
4.4. By accepting the prize, the winner agrees that we may use their name for promotional purposes.
5. Liability and Indemnification
5.1. If the participant uploads photos, the participant warrants that they will not submit any content whose provision, publication, or use violates applicable law or the rights of third parties.
5.2. The participant indemnifies BLACKROLL® against any and all claims by third parties arising from the illegality of photos used by the participant. This indemnification obligation also includes the obligation to fully reimburse BLACKROLL® for legal defense costs (e.g., court and attorney’s fees).
6. Data Protection
6.1. Providing personal data is required to participate in the contest. We collect, store, and use the personal data collected for the purpose of conducting the contest. None of the participant’s personal data will be disclosed to third parties or made available to them for use without the participant’s consent. However, in this context, BLACKROLL® is entitled to transfer the winner’s data to cooperation partners in order to facilitate the delivery of the prize. Winners may be named on websites and/or on the social media channels of BLACKROLL® and/or its respective cooperation partners. The winner expressly agrees to this form of publication.
6.2. The participant may revoke their consent at any time. The revocation must be submitted in writing or via email to BLACKROLL®. Upon revocation of consent, the participant’s collected and stored personal data will be deleted immediately.
6.3. If the participant subscribes to a newsletter as part of the contest, the terms and conditions specified in connection with the newsletter registration, including our privacy policy, apply with regard to the use of their data.
7. Final Provisions
7.1. BLACKROLL® reserves the right to terminate the contest early or extend its duration at any time without prior notice and without stating reasons. This applies in particular if the scheduled course of the contest is disrupted or prevented. In such a case, participants shall have no claims against BLACKROLL®.
7.2. BLACKROLL® reserves the right to exclude participants from the contest for good cause and to reclaim prizes, particularly if there is reasonable suspicion or evidence of false information, manipulation, violation of these Terms and Conditions, or other unauthorized actions.

7.4. The contest is governed by the laws of the Federal Republic of Germany. Legal recourse is excluded.
